From RFQ to Subcontractor Contract: Automating the Tender Cycle in Construction
A medium-sized construction project typically involves many subcontractors. Managing the complete cycle, from Request for Quotation (RFQ) to signed contract, traditionally takes weeks of emails, phone calls, and manually edited Word documents. This process can now be largely automated.
Italian Regulatory Framework
The new Public Contracts Code (D.Lgs. 36/2023, in effect since 1 July 2023) redefined subcontracting obligations. Key points: under Art. 119 there is no fixed percentage cap on subcontracting (the contracting authority can reserve specific works to the main contractor only with a stated justification in the tender documents), but handing a third party the entire execution of the contract, or the prevalent execution of the prevalent category or of labour-intensive contracts, is void. SOA qualification verification remains mandatory, payment traceability via dedicated accounts with CIG/CUP is required by Law 136/2010, and the main contractor bears joint liability for subcontractor employee payments.
Automating the RFQ Cycle
Modern systems replace the Excel spreadsheet with a structured subcontractor database including SOA qualification status with expiry alerts, DURC validity, insurance certificates, and performance history. Multi-supplier RFQ dispatch becomes a single click, with subcontractors completing structured online forms rather than sending PDF attachments.

Contract Generation and Digital Signature
Once a subcontractor is selected, the system auto-generates a legally updated contract template populated with registry data. Digital signature via DocuSign, Namirial, or InfoCert Sign (all eIDAS-compliant) replaces the print-sign-scan-mail cycle. Qualified electronic signatures (FEQ) have the same legal value as handwritten signatures under Italian law.
